Greek Authorities Act to Block Gaza Peace Flotilla 52


The US ship in the Gaza peace convoy has been blocked from sailing by the Greek authorities on the grounds that they have received a “Private complaint” that the vessel is unseaworthy.

This is ludicrous. What if I were to choose a large commercial vessel in a Greek port from Lloyd’s Register, and make a “privare complaint” that it is unseaworthy. Would it be blocked from sailing? Of course not – I should be asked to produce grounds for my complaint. Vessels cannot simply be detained on the basis of vexatious complaint. International trade would grind to a halt.

We do not yet know who actually made this complaint, nor why the port authorities have chosen to act on it. They have told the vessel it will now be subject to inspections which may take some weeks. The legal way forward must be to seek in a Greek court to stop the Greek authorities from this obviously political action in detaining the ship and disrupting the peace convoy. Secondly it is difficult to believe that the Greek people, who are not fond of their government, will approve of it acting as a pure US and Israeli puppet in this way. Political pressure needs to be brought to bear as well.

I should not be surprised any more by the cynicism of western governments, yet I still am, continually. I wonder if I will die still expecting the world to get better.

    Israel tries to argue that Gaza is disputed and not occupied territory.
    If the territory was occupied it has one set of implications for maritime territorial boundaries – and – if it is not then another set of territorial boundaries would apply under international law.
    The question then is what is the position under international law.
    Legal provisions
    – Hague regulations Oct. 1907, Section 3 Article 42-56:
    – Article 42 states that “territory is considered occupied when it is actually placed under the authority of the hostile army. The occupation extends only to the territory where such authority has been established and can be exercised.”
    – The Geneva Conventions, which include the core tenants of International Humanitarian Law, are applicable; specifically Geneva Convention 4 Relative to the Protection of Civilian Persons in Time of War.
    – The fourth Geneva Convention defines an occupation and the conduct that an occupying power should follow.
    In summary, and how I see it. After the cessation of hostilities re. 1948 Jewish settlement (read: Israel-Egypt Armistice agreement) the boundaries must bear reference to that period – unless one negates any applicability of international law applied to the 1948, 1967 hostilities, or any other law ( domestic – or – international ) for that matter to any other period of hostilities. Land borders are the basic prerequisite for determining maritime boundaries.
    Under international law, a country does not acquire territory, by reason of victory. Thus, we are back to the 1967 borders and that is what one has to refer to in respect of the true territorial limits relative to the present application of international law.
    This all then leads to computations of:-
    1. The Exclusive Economic Zone ( EEZ) and computation of equidistant lines.
    2. The international waters.
    3. And 1 and 2 above starting from a base of where the actual land boundaries in Gaza are.
    Beyond this we get into murky waters, albeit – it is not Israel’s territory to superimpose itself on Gaza’s territory.
